Alternative Dispute Resolution (ADR)
What is ADR?
Alternative Dispute Resolution (ADR) refers to structured processes and mechanisms used to resolve disputes outside of formal court litigation. ADR methods—such as mediation, arbitration, and negotiation—offer parties a more flexible, cost-effective, and time-efficient means of resolving conflicts. In Kenya, ADR is not only recognised but actively promoted under Article 159(2)(c) of the Constitution, which mandates courts to encourage the use of alternative forms of dispute resolution including reconciliation, mediation, arbitration, and traditional dispute resolution mechanisms (so long as they are not repugnant to justice and morality or inconsistent with the Constitution).
Our ADR Services
We emphasize resolving disputes outside the courtroom. We provide mediation and arbitration ADR services including mediation and arbitration.
Mediation involves a neutral third party helping both sides reach an agreement. Mediation enables a win-win for both parties. We provide mediation services as mediators or as legal counsel in the mediation.
Arbitration is a more formal dispute resolution process where an arbitrator makes a binding decision similar to that of a judge in a courtroom. An arbitration award is final and binding. We are certified arbitrators with an in-house arbitration practice and as counsel in arbitrations.
Litigation Services
When disputes escalate or parties are unable to resolve them through ADR, the dispute proceeds to court. We represent clients in litigation. Our team is skilled in all aspects of litigation, from drafting pleadings to representing clients in court. We prepare thoroughly, ensuring that your case is strong and persuasive.
